Prevent map labels placement under layout elements

Is there a setting or way to prevent Maplex from placing labels under layout elements? By layout elements I mean the title, legend, north arrow, and scale bar.

Yes, you can do this.  There are two approaches you can take. 

One is to create a geographic polygon feature that has of the extent of the page layout elements and then set the symbology so that the outline and fill are No Color. 

The other, which in many cases will be the easier one, is to double click the data frame to make it focused and then add graphic element to the map that are also polygons with No Color for the outline and the fill.  When you do this, the graphic features will be placed in an annotation group which is a property of the data frame.  If you do not specify a new annotation group, the features will be associated with the Default annotation group.
